AmericaByNumbers respects the intellectual property rights of others and expects its users and readers to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), AmericaByNumbers will respond expeditiously to claims of copyright infringement that are reported to our Designated Agent identified below.

Data Attribution Notice

The vast majority of data presented on AmericaByNumbers is derived from U.S. federal government public-domain sources — specifically the Bureau of Labor Statistics (BLS), the U.S. Census Bureau (ACS), the College Scorecard (U.S. Department of Education), and the U.S. Department of Labor (DOL). Works of the U.S. federal government are not subject to copyright under 17 U.S.C. § 105. Our attributions, methodology, and transformations are documented on /methodology/ and /data-sources/.

Filing a DMCA Takedown Notice

If you believe that content on AmericaByNumbers infringes your copyrighted work, please send a written notice of claimed infringement to the Designated Agent above. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following elements:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works at a single site, a representative list).
  3. Identification of the material that is claimed to be infringing and that is to be removed, with reasonably sufficient information to permit us to locate the material — typically the full URL on https://americabynumbers.com.
  4. Information reasonably sufficient to permit us to contact the complaining party: name, mailing address, telephone number, and email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Caution — 17 U.S.C. § 512(f): Any person who knowingly materially misrepresents under this section that material is infringing may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer or by AmericaByNumbers as a result of reliance upon such misrepresentation.

Our Response Procedure

Upon receipt of a substantially conforming DMCA notice, AmericaByNumbers will:

  1. Acknowledge receipt of the notice to the complaining party.
  2. Expeditiously remove or disable access to the material claimed to be infringing.
  3. Take reasonable steps to notify the user who posted the material that the material has been removed or disabled (where applicable — AmericaByNumbers is primarily a publisher of automatically generated government-data pages; user-generated content is limited to optional newsletter sign-ups).
  4. Document the notice and our response for our records.

Counter-Notification Procedure

If you believe that material you posted was removed or access to it was disabled as a result of mistake or misidentification, you may file a counter-notification with our Designated Agent. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, for any judicial district in which AmericaByNumbers may be found), and that you will accept service of process from the person who provided notification of claimed infringement or an agent of such person.

Upon receipt of a valid counter-notification, AmericaByNumbers will forward a copy to the original complaining party. Unless the complaining party files an action seeking a court order against you within 10–14 business days following receipt of the counter-notification, we may restore the removed material.

Caution — 17 U.S.C. § 512(f): A knowing material misrepresentation in a counter-notification may also give rise to liability for damages.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, AmericaByNumbers has adopted a policy of terminating, in appropriate circumstances and in its sole discretion, the accounts or access rights of users or readers who are deemed to be repeat infringers. AmericaByNumbers may also, in its sole discretion, limit access to AmericaByNumbers and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

International Notices

AmericaByNumbers operates from Germany and primarily serves a U.S. audience. Rights holders outside the United States may also contact our Designated Agent above. Where a DMCA-compliant notice is not practicable under foreign law, we will consider good-faith requests that include: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material (URL); (c) a statement of claimed ownership and non-authorization; and (d) contact information for the rights holder.

Amendments

We may update this DMCA Policy from time to time to reflect changes in law, operations, or contact details. The "Last updated" date above reflects the most recent revision. Please refer to this page for the current Designated Agent contact information before sending any notice.
